Grounding Lab Co., Ltd. (hereinafter referred to as "the Company") recognizes the importance of personal information entrusted to us by customers who use our services (hereinafter referred to as "Customers"). For the purpose of enabling Customers to use our services with peace of mind, we have established the following Privacy Policy. Customers who use our services are deemed to understand this Privacy Policy and agree to make it a part of the contract.
1. About Personal Information
In this Policy, "personal information" refers to "personal information" as defined in the Japanese Act on the Protection of Personal Information (hereinafter referred to as "the Personal Information Protection Act"). Regarding this service, the Company may acquire Customer information including, but not limited to, the following. This information may include personal information.
• Information registered by the Customer for this service (refers to information that can identify a specific individual through description, such as date of birth, address, name, telephone number, email address, and password, etc.).
• Information concerning communication terminals (refers to the Customer's IP address, usage status, history, location information, device used, services previously used or products purchased, pages/advertisements viewed, search keywords searched by the Customer, time of use, method of use, usage environment, postal code, gender, occupation, age, the Customer's IP address, cookie information, location information, terminal identification information, etc.).
2. Purpose of Use of Personal Information
The Company will use the acquired personal information for the following purposes. If, upon acquiring personal information, a purpose of use is notified separately from this Policy, the Company will use such personal information for the individually notified purpose in addition to the following purposes.
• To display registration information such as name, address, contact information, and payment method, as well as information regarding services used, products purchased, and their prices, in order to allow Customers to view and correct their registered information and view their usage status.
• To use contact information such as name and address for sending purchased products, etc., and for related communications.
• To use for delivering and sending information regarding the Company's services and special offers, if requested by the Customer.
• To use information such as name, date of birth, address, telephone number, bank account number, credit card number, driver's license number, and delivery confirmation results of certified mail, etc., for the purpose of verifying the Customer's identity.
• To use information related to payment such as names and quantities of purchased products, types and periods of services used, number of uses, billing amounts, names, addresses, bank account numbers, and credit card numbers, etc., for the purpose of billing Customers for payments.
• To display information registered with the Company on input screens or to transfer it to other services (including those provided by partners) based on the Customer's instructions, in order to facilitate data input by Customers.
• To refuse the use of this service by Customers who delay payments, cause damage to third parties, or violate the terms of use of this service, or by Customers who attempt to use the service for fraudulent or improper purposes, by using information such as usage patterns, name, and address to identify individuals.
• To use information necessary for the Company to provide services to Customers, such as inquiry details and billing information, as well as the Customer's service usage status and contact information, etc., for the purpose of responding to Customer inquiries.
• To create statistical materials categorized by Customer attributes (age, address, etc.).
• To provide and display information and services optimized for each Customer's preferences.
• When the Company deems it necessary to contact the Customer.
• To plan, consider, develop, and provide new services.• To extract targets for surveys conducted in relation to this service or new services.
• To optimize content, advertisements, etc., displayed on this service for individual Customers.
• To provide information regarding system maintenance/improvement, troubleshooting, and technical support related thereto.
• Other purposes incidental or related to the above purposes of use and the Company's business.
3. Change of Purpose of Use of Personal Information
The Company may change the purpose of use of personal information within a scope that is reasonably deemed to have substantial relevance. In the event of a change, the Company will inform the Customers on the website operated by the Company.
4. Restriction by Purpose of Use
The Company handles personal information within the scope necessary for achieving the purpose of use. If personal information is handled beyond the scope of the purpose of use, it will be done after obtaining the Customer's prior consent. However, this shall not apply in the following cases:
• When required by laws and regulations.• When it is necessary for the protection of a person's life, body, or property, and it is difficult to obtain the consent of the individual.
• When it is especially necessary for the improvement of public health or the promotion of the sound upbringing of children, and it is difficult to obtain the consent of the individual.
• When it is necessary to cooperate with a state organ, a local government, or an entity entrusted thereby in executing affairs prescribed by laws and regulations, and obtaining the consent of the individual may impede the execution of such affairs.
5. Acquisition of Personal Information
The Company acquires personal information by lawful and fair means and does not acquire it by fraudulent means against the Customer's will. When indirectly acquiring personal information, the Company confirms whether the information provider has properly acquired the personal information from the individual concerned. Personal information acquired, whether indirectly or directly, will be handled appropriately.
6. Secure Management of Personal Information
The Company exercises necessary and appropriate supervision over its employees to ensure the secure management of personal information against risks such as loss, destruction, alteration, and leakage of personal information. Furthermore, when entrusting all or part of the handling of personal information, the Company will conclude a confidentiality agreement or similar agreement with the entrusted party that conforms to the content of this Policy in advance, and will exercise necessary and appropriate supervision to ensure the appropriate secure management of information by said entrusted party.
7. Provision of Personal Information to Third Parties
The Company will not provide personal information to third parties without the Customer's prior consent, except in the cases listed below. However, this excludes cases permitted by the Personal Information Protection Act or other laws and regulations.
• When providing personal information to operators who optimize the delivery or display of advertisements of the Company or third parties for individual Customers.
• When providing personal information to a third party based on the Customer's instructions or consent.
• When the provision of acquired information is requested by a court, supervisory authority, or other public institution, etc., and the provision of personal information to a third party is permitted by the Personal Information Protection Act.
• In addition to the above, for the purpose of product delivery, payment settlement, responding to Customer inquiries, making inquiries from the Company to Customers, providing related after-sales services, or conducting information surveys/analyses, etc., the Company may outsource a part of its operations concerning the operation of this service to a third party (including third parties located in foreign countries) and may provide personal information to the entrusted third party in such cases. In this case, the Company will conclude a contract concerning the outsourcing of personal information and exercise necessary and appropriate supervision over the entrusted third party.
• When outsourcing personal information handling operations to another company.
• When there is an imminent danger to a person's life, body, or property, and there is an urgent necessity.
• In addition to third-party provision permitted by the Personal Information Protection Act (such as provision to delivery companies), when the recipient provides or discloses to a re-entrusted party, etc., within the scope necessary for the execution of the entrusted work.
• When there is a particular necessity for the improvement of public health or the promotion of the sound upbringing of young people.
• When disclosing to the successor of a business during a business succession due to merger, business transfer, or other reasons.
• When permitted by the Act on the Protection of Personal Information or other legislation.
• When it is deemed necessary to protect the rights or property of other members, third parties, or our company, in cases where there is a violation of the Terms of Use, etc., of "PICO PARK STORE."
8. Joint Use of Personal Information
For the purpose of achieving the purposes of use stipulated in this Policy, or purposes of use individually notified to Customers by the Company, the Company may jointly use Customer personal information acquired by the Company in this service with its parent companies, subsidiaries, and affiliated companies. In this case, the items of personal information to be jointly used will be the information described in "1. About Personal Information" above. The purpose of use by the joint users will be the purposes described in "2. Purpose of Use of Personal Information" above (however, "the Company" shall be read as "the Company's parent companies, subsidiaries, and affiliated companies", and "this service" shall be read as "services provided by the Company's parent companies, subsidiaries, and affiliated companies"). The Company shall be the party responsible for the management of such personal information. In this case, the Company will manage Customer information responsibly and ensure that handling is carried out in accordance with this Policy. Furthermore, the Company may jointly use Customer personal information with its business partners to the extent necessary for providing partnered services. In such cases, the Company will publicly announce in advance the name of the partnered party (including the name or title of the responsible manager), the purpose of joint use, and the types of information to be jointly used.
9. Disclosure, etc., of Personal Information
The Company will respond without delay to requests from Customers for disclosure, correction, addition or deletion of content, suspension of use, notification of purpose of use, erasure, and suspension of provision to third parties (hereinafter collectively referred to as "Disclosure, etc."), in accordance with the following items.
• When a request for Disclosure, etc., is received from a Customer, the Company will perform Disclosure, etc., after verifying the Customer's identity using the method stipulated below or a method separately designated by the Company. However, if the Company is not obligated by law to perform Disclosure, etc., the Company may, at its discretion, not perform Disclosure, etc.
• Identity will be confirmed by sending an email to the email address already provided by the Customer and requesting a reply to that email.• Identity will be confirmed by verifying the Customer's name, address, telephone number, date of birth, etc., during the procedure.
• The procedure for Disclosure, etc., after identity verification is completed will be separately guided by the Company after the completion of identity verification.
• For Disclosure, etc., a fee of 1,000 yen will be charged per application. However, in the following cases, all or part of the information may not be disclosed:
• When there is a risk of harming the life, body, property, or other rights or interests of the Customer or a third party.
• When there is a significant impediment to the proper implementation of the Company's business.
• When there is a risk of violating other laws and regulations.
10. About Services Provided by Third Parties
The Company may provide information such as cookies and access logs to third parties in order to optimize the quality of this service or the content and advertisements displayed to individual Customers, using services provided by third parties.
11. Continuous Improvement
The Company shall comply with laws, regulations, and other norms, review the operational status regarding the handling of personal information as appropriate, and strive for continuous improvement, and may change this Policy as necessary. Any changes to this Policy will be announced on the Company's website or by other easily understandable methods. However, when making changes to content that requires the Customer's consent by law, the Company will obtain the Customer's consent by a method separately determined by the Company.
